TERMS-1 Agreement and provider

These Terms govern your use of the evobeing website, website account and any digital service that is expressly presented with these Terms. The contracting provider is evobeing LLC, 45 E Loucks St, 2nd Floor, Sheridan, WY 82801, United States. By creating an account or using a covered service, you agree to these Terms. Purchases are also governed by the Terms of Sale and the policies shown at checkout. Mandatory consumer rights always prevail where they cannot be waived.

TERMS-2 Eligibility

You must be at least 18 years old and have legal capacity to accept these Terms. The website, purchases, accounts and covered digital services are adult-only.

TERMS-3 Account and security

Provide accurate information, keep your credentials confidential and notify us promptly if you suspect unauthorized use. An account and its paid benefits are personal unless a feature expressly permits sharing or transfer. You are responsible for activity you authorize, subject to our obligations and applicable law.

TERMS-4 License

For a digital service made available to you, we grant a limited, personal, non-exclusive and non-transferable license to use it for its stated consumer purpose during the applicable service period. The license ends when the service or your lawful access ends. It does not transfer ownership of software, content or intellectual property.

TERMS-5 Service features and changes

The features, compatibility, service period and any free or paid elements are those described on the relevant product page, purchase screen or service interface. We may make changes needed for security, legal compliance, compatibility or service maintenance. We will not materially reduce a paid service during its purchased term without the notice, consent or remedy required by the purchase terms and applicable law. Mandatory conformity, update, notice and termination rights remain unaffected.

TERMS-7 Health boundary

Unless authorized product labeling expressly says otherwise, evobeing content and digital features are for general wellness and informational purposes. They do not replace diagnosis, treatment, emergency services or professional care. Follow the Health and Medical Disclaimer and any safety instructions supplied with the product.

TERMS-8 Your content and instructions

You retain your rights in information you submit. You permit us to host, process and transmit it only as reasonably necessary to provide the feature you request, operate the service and comply with law, subject to the applicable privacy policy and your choices. These Terms do not authorize an unrelated use of your content.

TERMS-9 Acceptable use

Do not interfere with security, access another person's account, introduce malicious code, overwhelm or scrape the service outside published interfaces, resell personal access, violate law or third-party rights, or use the service to harm others. Restrictions do not limit lawful interoperability, security research, fair use or another right that cannot be waived.

TERMS-10 Third-party services

App stores, payment services, integrations and external links may be governed by third-party terms. We remain responsible for our own obligations but do not control an independent third party's service. Disconnecting an integration generally stops future transfers requested through that connection but may not retrieve data already provided.

TERMS-11 Paid services

A paid or recurring service applies only if the purchase page clearly identifies it and displays the price, billing interval, service period, renewal terms, cancellation method, any trial and any included benefit before payment. A one-time purchase does not become recurring through these Terms. Additional recurring-purchase terms apply only to an offer expressly identified as recurring.

TERMS-12 Intellectual property

evobeing and its licensors own the service software, designs, trademarks and protected content, excluding your content and third-party material.

TERMS-13 Suspension and termination

We may proportionately restrict or suspend access to protect users or systems, investigate fraud or abuse, comply with law, address nonpayment or respond to a material breach. Where appropriate, we provide notice and a reasonable opportunity to resolve the issue. Termination does not remove accrued rights, outstanding payment obligations or privacy rights.

TERMS-14 Availability and warranties

Digital services may occasionally be interrupted for maintenance, security, network conditions or events outside reasonable control. Any disclaimer applies only to the extent permitted by law. Express product commitments, a voluntary warranty expressly offered at purchase and mandatory consumer guarantees remain unaffected.

TERMS-15 Liability

Each party remains responsible for loss caused by its breach to the extent required by applicable law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable liability for fraud, willful misconduct, death or personal injury, defective products, privacy violations or mandatory consumer rights.

TERMS-16 Disputes and governing law

Contact support@evobeing.com first so we can try to resolve a concern. These Terms do not impose mandatory arbitration or a class-action waiver. The law and courts available under applicable consumer, contract and procedural rules govern any unresolved dispute, and you keep any right to bring a claim or use an alternative dispute process available in your place of residence.

TERMS-17 Updates

We may update these Terms for later use of the website or services. An update does not retroactively change a completed purchase or remove an accrued right. We provide notice, obtain consent and preserve applicable termination or refund rights when required by law or contract. Continued use is not treated as consent where affirmative agreement is required.

SALE-1 Seller and scope

These Terms apply to products and paid services bought directly from evobeing. The seller is evobeing LLC, 45 E Loucks St, 2nd Floor, Sheridan, WY 82801, United States. A purchase from a third-party retailer is governed by that retailer's sale terms, without reducing any mandatory right you may have against the responsible party.

SALE-2 Offer and acceptance

Submitting an order is an offer to buy the items shown at checkout. We acknowledge receipt electronically. The order is accepted when we send an acceptance or dispatch confirmation or otherwise clearly confirm acceptance. We may decline an order for genuine stock, payment, fraud-prevention, geographic or legal reasons and will release a payment authorization or refund a captured payment as required.

SALE-3 Product and price information

Before payment, checkout displays the product or service, quantity, total price, currency, known taxes and shipping charges, any recurring amount, and material purchase, return or trial terms. Product features, included items and prices are those displayed when you order. A comparison price, included benefit or promotional value applies only when it is expressly shown in the offer.

SALE-4 Payment

You authorize the one-time or recurring charge clearly displayed before payment using your selected method. Payment providers may process credentials under their own privacy terms. A failed or reversed payment may delay fulfillment or suspend an unpaid service, subject to notice and applicable law.

SALE-5 Taxes and import charges

Checkout displays taxes, duties, brokerage or similar charges that we collect and can determine before payment. For an international delivery, the purchase page or checkout states whether additional import charges may be collected by a carrier or authority. We do not add an undisclosed mandatory charge after you place the order.

SALE-6 Availability, substitutions and preorders

Products, colors and sizes are subject to availability. We will not substitute a materially different item without your agreement. A preorder applies only when the product page clearly identifies it and states the payment timing, estimated dispatch and available cancellation or delay remedies.

SALE-7 Delivery, title and risk

Delivery options and estimates are displayed at checkout or in the order confirmation. Title and risk pass at the time required by the delivery terms and applicable law. A carrier scan does not remove any remedy available for non-delivery, loss, damage or an item that does not conform to the contract.

SALE-8 Sizing

If a product requires size confirmation or offers a sizing kit, the product page explains the process. Use the method specified for the evobeing model because sizes may differ across brands or product generations. Any voluntary size exchange applies only when shown in the purchase terms.

SALE-9 Subscriptions and digital services

A recurring service applies only when checkout clearly identifies automatic renewal and displays the price, interval, service period, cancellation method and required consent before payment. A one-time purchase does not create a subscription. Mandatory cancellation, cooling-off and digital-service rights remain unaffected.

SALE-10 Returns and trial

The Return and Refund Policy applies. A voluntary 30-day trial or other return benefit exists only when the product page, checkout or order confirmation expressly offers it and states its eligibility and starting point. Any voluntary benefit supplements statutory cancellation, rejection, conformity, repair, replacement and refund rights.

SALE-11 Warranty

Mandatory consumer guarantees apply according to law. A separate voluntary limited warranty applies only if it is expressly offered for the product before purchase and identifies its provider, territory, duration, coverage and claim process. A paid plan or product benefit does not replace a remedy owed for a qualifying defect.

SALE-12 Export and lawful use

Products may be subject to trade, sanctions, import and lawful-use restrictions. Provide accurate destination and transaction information and use the product lawfully. We remain responsible for our own screening and consumer obligations.

SALE-13 Liability and mandatory rights

The Terms of Use govern general liability. Nothing in these Terms limits a right or remedy that cannot lawfully be limited. Mandatory rights in your place of residence or delivery continue to apply.

We send the order confirmation and applicable purchase terms to the contact information provided at checkout. Review the order before payment and contact us promptly if information is incorrect. SALE-15 EEA and UK orders

For an EEA or UK distance sale, checkout displays the required main characteristics, total and recurring price, duration, termination conditions and other material information immediately before the order. The final order control clearly communicates the obligation to pay, and we provide the contract confirmation on a durable medium. Statutory withdrawal, conformity, update, delivery and refund rights apply in addition to these Terms.
